1. Overview
This Fair Use Policy (“FUP”) explains reasonable and permitted use of Nimbus Sites’ Services, including website hosting and the included business email mailboxes. This FUP is incorporated into the Terms of Service.
2. Website Hosting Fair Use
- Hosting is intended for standard small-business websites and typical business traffic patterns.
- You may not use our hosting for file storage, media streaming, bulk downloads, software distribution, or as a CDN for third parties.
- You may not run crypto-mining, botnets, scraping at scale, or any activity that degrades platform stability or violates law.
3. Email Fair Use (Zoho Mail)
Zoho Mail disclaimer (third-party service):
Email mailboxes included with your plan are provisioned through Zoho Mail. Your use of Zoho Mail is subject to Zoho’s own terms, fair use/acceptable use policies, and technical limits. Nimbus Sites does not control Zoho’s services and is not responsible for outages, suspensions, enforcement actions, deliverability, or limitations imposed by Zoho. You are responsible for reviewing Zoho’s policies directly on Zoho’s website and complying with them at all times.
- The included mailboxes are for normal business correspondence.
- Mass marketing/bulk emailing may require separate tools and compliance with applicable laws (e.g., CAN-SPAM in the U.S.).
- You are responsible for sender reputation, lists, consent, and legal compliance.
4. Technical Limits & Throttling
We may apply rate limits, bandwidth caps, storage caps, or other technical controls to protect the service and other customers. Limits may vary by plan and may be updated over time.
5. Enforcement
- If we believe your use violates this FUP, we may request changes, temporarily restrict service, or suspend/terminate your access.
- In urgent cases (security, abuse, legal risk), we may act immediately without prior notice where permitted by law.
- Violations may result in loss of eligibility for “free build” promotions and may trigger the remedies in the Terms.
